Brussels in the Snow! After lasts years wash out trip to Brussels, it weather was brilliant this year. With beautiful snow and blue skys on Saturday and more thick, heavy snow on Sunday. We returned on Monday morning to a very snowy Britain. IT took 9 hours to get home, but we were lucky to be on one of only three trains that ran during the day.

Parmigiano Reggiano Cheese Museum
Collecting material for the museum took place in all 5 provinces where Parmigiano-Reggiano is produced. The objects on display can be placed in a time frame between the second half of the XIX century and the first half of the XX century.
Given the relative homogeneity of the material it was decided to lay out the exhibition as though we were getting the antique cheese factory of the Meli-Lupi family ready for action. In fact, all objects necessary for the transformation of milk are present in the oldest part of the building, whereas in the newer part those elements of the production process which do not involve transformation are arranged. Thus we can find here the maturing process, marketing and sales, as well as information about use of the cheese in gastronomy and its history.
The cheese making plant is special for its circular structure which makes it a particularly prized building in terms of its large size, harmonious both inside and out and the decorative order throughout.

Deutsche Bank Settles Tax-Fraud Case

NEW YORK—Deutsche Bank AG agreed Tuesday to pay $553.6 million and admitted criminal wrongdoing to settle a long-running probe over fraudulent tax shelters that allowed clients to avoid paying billions of dollars in U.S. taxes.

Under a nonprosecution agreement with the U.S. Attorney's office in Manhattan and the Internal Revenue Service, the German bank won't be prosecuted for its participation in about 15 tax shelters involving more than 2,100 customers between 1996 and 2002, including shelters marketed by accounting firm KPMG LLP and defunct law firm Jenkens & Gilchrist PC.

"Customers used the transactions to generate more than $29 billion in bogus tax benefits, mainly losses," according to the agreement.

The $553.6 million payment represents the total fees that the bank collected during the period, the taxes and the interest the IRS was unable to collect during the period, and a civil penalty of more than $149 million.

"Deutsche Bank is pleased that this investigation, which concerned transactions that ceased more than eight years ago, has come to a resolution," the bank said in a statement.

Deutsche Bank said it previously had taken "appropriate provisions" for the full amount of the fine and it won't have an impact on current net income.

The agreement resolves an investigation that stemmed from aggressive, prepackaged tax shelters that the government believed were fraudulent.

More than a dozen people were charged criminally in the matter. However, a federal judge threw out charges against 13 former KPMG executives in 2007 after finding prosecutors violated their rights to counsel by putting undue pressure on the accounting firm not to advance them defense costs.

A former KPMG LLP tax partner, a onetime KPMG senior tax manager and a lawyer in a case were convicted of criminal charges in 2009 in a case once billed as the largest tax-shelter fraud prosecution in U.S. history. The investigation is continuing.

KPMG itself signed a deferred prosecution agreement in which it admitted to the fraudulent sale and marketing of bogus tax shelters and agreed to pay a $456 million penalty.

A conspiracy charge against KPMG was dropped in December 2006.

The shelters at issue included so-called Blips, or bond-linked issue premium structure; Flips, or foreign leveraged-investment program; and OPIS, or offshore portfolio-investment strategy.

Jenkens & Gilchrist issued opinion letters touting the legitimacy of the transactions underlying some of the shelters and marketed some of the shelters. The firm closed its doors in 2007 after entering into an agreement avoiding prosecution and paying a $76 million IRS penalty.

Last year, criminal charges were brought against seven people related to the Jenkens & Gilchrist shelters, including three former Jenkens & Gilchrist lawyers, two former Deutsche Bank employees and the former chief executive of accounting firm BDO Seidman LLP. Two people pleaded guilty in that case.

As part of its agreement Tuesday, Deutsche Bank agreed not to be involved with any type of prepackaged tax products and to adopt an ethics and compliance program. The bank also agreed to cooperate with prosecutors.

German Consumer Sentiment Drops

FRANKFURT—German market research group GfK's forward-looking consumer climate index for January declined from the previous month, reflecting expectations of slower growth, GfK said in a statement Tuesday.

However, the research group said consumers still expect the German economy, Europe's largest, to remain on an upward trend.

The January index came in at 5.4 points, down from 5.5 in December. Economists surveyed forecast a rise to 5.7 points. "Although the economic expectations at year-end show some losses, consumers continue to see the German economy clearly on a growth path," GfK said in a statement.

GfK's overall consumer index refers to the next month but its subindexes—economic expectations, income expectations and buying propensity—refer to the current month. In December all three subindexes fell.

The economic expectations index fell to 58.8 points in December from 65.8 points in November, reversing a rise of six consecutive months. "This level signals that consumers continue to see the German economy clearly recovering," GfK said.

GfK said the pronounced optimism about the economy is well founded, as it has also been reflected by the current increase in the Ifo business climate index. The Ifo index hit a record high of 109.9 in December, the highest level since Germany's reunification.

GfK also said employment is expected to continue to rise in 2011, and the number of unemployed will be below three million people on average. The shorter-hours work regime, introduced during the economic crisis, will practically disappear, GfK said, adding that in summer 2009, about 1.5 million people worked shorter hours.

Income expectations fell to 40.3 points in December from 44.9 points in November, while the buying propensity declined to 33.8 points from 39.3 points.

"Employees hope that the good economic situation means that there will be more room to maneuver for higher wages in coming wage negotiations," GfK said. It added that several companies have announced plans to bring forward by two months wage increases originally planned for April, or give employees a one-off payment.

The buying-propensity index declined after what GfK called an "unusually strong" increase in November. In November, buying propensity surged to 39.3 points from 22.5 points.

The decline in buying propensity is due to the slightly higher price expectations and the lower income expectations, GfK said, adding that petrol and heating oil price rises have raised inflationary fears.

Catholic Church's role in care at Ariz. hospital hotly debated

As the Catholic Diocese of Phoenix and St. Joseph's Hospital and Medical Center continued to talk Wednesday about the church's role in medical decisions, the national debate escalated over whether the local bishop's threat to remove the hospital's Catholic status was appropriate.

Several national observers questioned whether Bishop Thomas Olmsted, who oversees matters concerning the Catholic Church in the Phoenix diocese, should be allowed to impose upon a hospital's potentially life-saving medical practices. The issue stems from the hospital's decision last fall to terminate a pregnancy that posed serious health risks to the mother.

Other observers, however, said the bishop's move underscores the beliefs of many patients.

"The faith, the mission to witness Christian love through excellence in health care, is very strong," said Dr. Jim Sabin, a professor at Harvard Medical School and author of the blog Health Care Organizational Ethics. "They have a deep sense of mission. To a Catholic person, that is hugely meaningful."

The diocese and the hospital on Wednesday confirmed that they are discussing the bishop's demands that the hospital agree to several conditions to ensure it is adhering to church teaching. Both parties declined further to discuss publicly the status of the situation. Olmsted, in a letter to the hospital's parent company in November, set a deadline of Friday for the hospital to comply.

"St. Joseph's and Catholic Healthcare West continue to be in dialogue with Bishop Olmsted, and we hope to achieve a resolution," said Suzanne Pfister, vice president of communications for the hospital. "We believe that all life is sacred. In this case, we saved the only life we could save, which was the mother's."

Rob DeFrancesco, diocese spokesman, said the bishop is working with the hospital to find a resolution.

"The bishop and his staff are working together with Catholic Healthcare West and St. Joseph's Hospital to find the best way to provide authentic Catholic health care in accordance with the church's teaching," he said.

In his November letter to Catholic Healthcare West, the bishop said discussions over the case had gone on long enough. The hospital terminated the pregnancy because the mother had pulmonary hypertension and the condition with the pregnancy posed a threat to her life. Doctors conducted the procedure after consulting with Sister Margaret McBride, a member of the hospital's ethics committee. Olmsted later said that McBride and any Catholic involved in the procedure faced excommunication from the church.

Olmsted, in the letter, demanded that the hospital submit to his authority by acknowledging he was correct in declaring the procedure an abortion, that the hospital allow him to conduct a review and certification to guarantee compliance with Catholic teachings, and that hospital staff receive training from the diocese or another Catholic agency on the church's Ethical and Religious Directives, a document from the national bishops council that explains Catholic moral teachings for health-care providers.

Failure to comply, he said, would result in his declaration that the hospital was no longer Catholic and would no longer be allowed to hold Mass or keep on site communion wafers used during Mass. Priests and church ministers still would be able to care for patients at their request.

Olmsted made it clear that he was the final authority on Catholic Church matters in the Phoenix diocese.

A church's role in a hospital's health-care protocols is generating debate outside of Phoenix.

The American Civil Liberties Union on Wednesday renewed its appeal to the federal Centers for Medicare and Medicaid Services for an investigation of religious hospitals over concerns that they could deny potentially life-saving care.

Alexa Kolbi-Molinas, staff attorney with the ACLU Reproductive Freedom Project, said a hospital's first responsibility must be to its patients, not to a religious leader.

"Religiously affiliated hospitals are not exempt from federal laws that protect a patient's right to receive emergency care and cannot invoke their religious status to jeopardize the health and lives of pregnant women," she said. "Women should never have to be afraid that they will be denied life-saving medical care when they enter a hospital."

Lois Uttley of MergerWatch, a New York organization that reviews issues that arise when secular and religious hospitals merge, said that in her opinion, St. Joseph has "tried mightily to balance its religious heritage with its provision of medical care." She said Catholic Healthcare West generally handles such issues well.

"They know better than the bishop how to do this," Uttley said.

She said similar issues arise frequently at Catholic hospitals.

"If protecting patients' rights and access to quality care means St. Joseph's has to relinquish its Catholic identity, it would be an unfortunate but inevitable outcome," she said.

If the bishop were to follow through on his threat, the hospital still could retain its name, one of the most established and widely recognized hospital names in Arizona.

Lisa Fullam, professor of moral theology at the Jesuit School of Theology at Santa Clara University, blogged at commonwealmagazine.org that the hospital ought to stand up to the bishop.

"Why don't they simply point out to Bishop Olmsted that, while under church law he can restrict who uses the appellation 'Catholic,' he does not have a copyright to the term under U.S. law? If the administrators at St. Joseph's believe it to be a Catholic hospital, they should continue to use the name and let the canonical chips fall where they may. The bishop does not own Catholicism, in his diocese or elsewhere."

However, Harold G. Koenig, director of Duke University's Center for Spirituality, Theology and Health, said spirituality may be very important to patients, especially Catholic patients.
